The statutory authority for this sole source acquisition is 10 U.S.C. 2304(c)(1) in accordance with FAR Part 6.302-1, only one responsible source and no other supplies or services will satisfy the agency requirement. The NAICS code for this acquisition is 334516, Analytical Laboratory Instrument Manufacturing. The period of performance for this procurement is one 90 days.
The purpose of this procurement is to purchase a Zephyr G3 SPE Workstation from PerkinElmer Health Sciences, Inc. to accommodate the increasing analyses demands and to ensure continuity of operations. The Zephyr SPE Workstation is the only product that can meet our compatibility and continuity requirements. At present, the program has two (2) Zephyr SPE Workstations that are used to perform nutritional biomarker analyses in full compliance with DLS Policies and Procedures and the Clinical Laboratory Improvement Amendments (CLIA). The Zephyr SPE Workstation has undergone extensive testing and validation in order to be incorporated into our methods and is identified by name in our required CLIA documentation. The procurement of a new Zephyr SPE Workstation exactly matches the configuration and the performance of the Zephyr SPE is the only means by which method performance can be guaranteed from both a continuity and compatibility standpoint. Substitution with a different, untested product poses a significant risk of altering method performance and may result in non-compliance with DLS Policies and Procedures. PerkinElmer Health Sciences, Inc. is the sole manufacturer of the Zephyr SPE Workstation and is the only known available source that satisfies our requirement.
As a result of this synopsis, no competitive solicitation will be posted on FedBizOpps.com. We will only issue a solicitation to PerkinElmer Health Sciences, Inc. A determination by the Government not to compete this proposed action will be based on responses to this notice and is solely in the discretion of the Contracting Officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
