The awarded contract will be a onetime purchase. The contract will authorize the end-user unlimited access to the above-mentioned eBooks. This order is being procured in accordance with FAR Part 12 (Acquisition of Commercial Items) and FAR Part 13 (Simplified Acquisition Procedures), to include FAR Part 13.5 (Test Program for Certain Commercial Items).
Funding is not yet available for this purchase.
FAR Part 52.232-18 Availability of Funds
Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

(b) Soliciting from a single source
(1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.
John Wiley & Sons, Inc. is the publisher and sole provider for the eBooks journal collection. Access to these journals is required by faculty, students and researchers for purposes of teaching and reasearch.
This is not a request for quotes and a solicitation package will not be issued. Sources interested in responding to this requirement must be able to provide compelling evidence that they can provide the abovementioned requirement as specified. A determination by the Government not to compete this proposed contractual action based upon responses received is solely within the discretion of the Government. Responses must be received via email ([email protected]) by 4:30pm on 1 June 2010.
