Naval Information Warfare Center (NIWC) Atlantic
intends to award a sole-source contract to Viasat,
Inc. (Viasat), 6305 El Camino Real, Carlsbad, CA,
92009, to provide tear down and evaluation of
Enhanced Bandwidth Efficient Modem with Ethernet
Service Expansion Module (EBEM W/ ESEM). Viasat
is the original equipment manufacturer and sole
source supplier of the required components and
authorized repair facility for the faulty materials
identified requiring Test and Evaluation (T&E) to
assess for repair. Per a reference letter received from
the manufacturer dated on 5 December 2019; Viasat
is a sole source in providing tear-down, test, and
evaluation services to the unique hardware and
software requirements of the EBEM W/ ESEM. In
addition, Viasat will provide repairs once T&E has
been completed. This will ensure materials remain
100% compatible with currently fielded systems and
protect Viasat proprietary rights for the materials.
The buyer shall keep confidential all information,
drawings, specifications, or data and that this
information may not be released or disclosed without
the prior written authorization of Seller. Viasat is a
sole source in providing tear-down, test, and
evaluation services to the unique hardware and
software requirements of the EBEMs. Viasat is the
only capable contractor to repair and bring this
system to the level required for continued
operations. No other contractor is authorized to
conduct Depot level, field maintenance, engineering,
and software support services. Additionally, the
manufacturer does not have or work through
resellers.
The authority for soliciting from a single source is
FAR 13.106(b)(1). The Government anticipates the
award of a Firm-Fixed-Price purchase order.
The proposed contract action is for supplies and
incidental services for which the Government intends
to solicit and negotiate with a single source under
authority of FAR 13.106-2. Interested firms may
identify their interest and capability to respond to the
requirement. This notice of intent is not a request for
competitive proposals. A determination by the
Government not to compete this proposed contract
based upon responses to this notice is solely within
the discretion of the Government. Information
received will normally be considered solely for the
purpose of determining whether to conduct a
competitive procurement. Responses and/or
