The National Institute of Standards and Technology (NIST) Acquisition Management Division, on behalf of the Materials Measurement Science Division, Material Measurement Laboratory, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Johnny Kirkland, Shoreham, NY, for the purchase of Beamline Data Acquisition and Control Software (XDAC) interfaces and upgrade to NIST's existing National Synchrotron Light Source (NSLS-II) Beamline at the Brookhaven National Laboratory in Upton, NY.


Sole Source determination is based on the following: NIST operates five (5) synchrotron beamline laboratories at the National Synchrotron Light Source (NSLS) located at the Department of Energy's Brookhaven National Laboratory in Upton, NY. These beamlines uses the data acquisition and control software XDAC. NIST requires the upgrade of the XDAC software interfaces between the NSLS and the NSLS-II beamlines. The XDAC software upgrades must be compatible between the NSLS beamline data acquisition and software and the NSLS-II beamline data acquisition and software.

Due to the proprietary nature of the XDAC software which operates this suite of 5 beamlines, Johnny Kirkland is the only vendor capable of providing the required software interface upgrade to NIST's existing beamlines in order to satisfy the Government's minimum requirements. Johnny Kirkland is the sole manufacturer and distributor.

The North American Industry Classification System (NAICS) code for this acquisition is 541511, and the size standard is $25,500,000.

No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by September 12, 2014, 3:30 p.m. EST.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
