The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to negotiate on a non-competitive basis with Olympus NDT NE, Incorporated, Kennewick, WA, for three (3) each Ultrasonic Flaw Detector, P/N S1200M-C-KIT01 in the base year, plus an option period of two years after date of contract award for up to an additional seven (7) each. The contract shall not exceed ten (10) units.

The Government intends to procure the above items under the authority of 10 USC 3204 (c) (1), FAR 6.302-1. The Government does not own data rights and competitive drawing package for this effort as the Original Equipment Manufacturer (OEM) is unwilling to sell their data rights. All responsible sources are encouraged to submit a proposal in writing that may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government, not to open the requirement to competition based upon the response to this notice, is solely within the discretion of the Government.
