***The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Bruker Biospin Corp. in Billerica, MA for the purchase of an HXY triple resonance NMR probe.*** ***The required probe will be used to integrate with an existing NIST-owned 300 MHz NMR spectrometer. Sole source determination is based on the need to maintain 100 percent compatibility with existing Bruker spectrometer. As the required technology is proprietary to Bruker Biospin, no other manufacturer has a commercially available probe that would be 100 percent compatible with NIST’s existing spectrometer. Bruker Biospin Corp. is the sole manufacturer and distributor of this equipment. ***Delivery shall be FOB Destination, Gaithersburg, MD, and is required within 150 days after receipt of order.*** ***The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees.*** ***No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by July 30, 2009.*** A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government.
