Synopsis:
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 "Synopses of Proposed Contract Actions." Due to the commercial nature of this item, the publicizing and response time is set to afford potential offerors a reasonable opportunity to respond in accordance with FAR 5.203(b).

The U.S. Army Corps of Engineers, Portland District intends to award a firm-fixed-price commercial supply contract to TNT Software, Inc., 2001 Main Street, Vancouver, WA 98660-2673. The purpose of this acquisition is to renew the following software licenses: ELM Enterprise Manager Log Licenses - Class I and Class II. The publisher/developer of these licenses is TNT Software, Inc.

The statutory authority for this non-competitive acquisition is 10 U.S.C. 2304(c)(1) as implemented by FAR 13.106-1(b)(1) - Soliciting from a Single Source for purchases not exceeding the simplified acquisition threshold.

A SOLICITATION WILL NOT BE POSTED
The Government intends to proceed with this single source action. The NAICS code is 511210 - Software Publishers. The size standard as defined by the U.S. Small Business Administration is $38,500,000 employees.

THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a capability statement that they are an authorized distributor for TNT's ELM Log Licenses. If no affirmative written responses are received by 12:00 PM Pacific Time on 09 August 2019, an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
