Issuing Procurement Unit State of Utah Division of Purchasing Conducting Procurement Unit State of Utah Division of Purchasing STATE OF UTAH COOPERATIVE CONTRACT INVITATION FOR BIDS STATE COOPERATIVE CONTRACT FOR COOKIE & SMALL SNACK CAKES SOLICITATION #NS20-53 This Invitation for Bids (âIFBâ) is issued in accordance with the Utah Procurement Code and applicable administrative rules of the Utah Administrative Code. If any provision of this IFB conflicts with the Utah Procurement Code or Utah Administrative Code, the Utah Procurement Code or Utah Administrative Code will take precedence. Purpose of this Solicitation The purpose of this IFB is to enter into a State of Utah Cooperative Contract with a qualified vendor to provide: Cookies and Small Snack Cakes - Little Debbie and Sunbelt. Closing date and time The closing date and time for this sourcing event is May 4, 2020, 3:00 PM Mountain Time. It is your responsibility to make sure you submit your response by the date and time indicated above. Eligible Users This State of Utah Cooperative Contract will be for the benefit of all Utah public entities, nonprofit organizations, and agencies of the federal government, i.e. State of Utah departments, agencies, and institutions, political subdivisions (colleges, universities, school districts, special service districts, cities, and counties, etc.). The following Eligible Users are allowed to use the awarded contract: State of Utahâs government departments, institutions, agencies, political subdivisions (i.e., colleges, school districts, counties, cities, etc.), and, as applicable, nonprofit organizations, agencies of the federal government, or any other entity authorized by the laws of the State of Utah to participate in State Cooperative Contracts will be allowed to use this Contract. Each Eligible User is considered an individual customer. Each Eligible User will be responsible to follow the terms and conditions of this IFB and will be responsible for its own charges, fees, and liabilities. The State is not responsible for any unpaid invoice. Contract Award It is anticipated that this IFB will result in a single award contract; however, we reserve the right to award multiple contracts if it is in our best interest. This solicitation must result in statewide coverage to our facilities. The contracts will be awarded using the following methodology: Award Methodology: The lowest bid may be awarded provided we achieve statewide coverage to our facilities. The low bid is determined by multiplying the Cost Per Unit by the 2019 Usage to determine the lowest aggregate sum of all product lines given by a responsive and responsible bidder based on the three Category Product Line Item Groups taking into consideration the Case Count, Case Cost and Cost Per Unit in Attachment C â Cost Sheet. Award will be made to the lowest total aggregate sum of all products (Attachment C- Cost Sheet Cell N30). Future Procurements The State of Utah reserves the right and may reopen this solicitation, or create a new solicitation if it determines there may be more competition for the procurement item than when the original solicitation was posted. Length of the Contract The contract resulting from this IFB will be for FIVE (5) years. Background The previous Statewide Cooperative Cookies and Small Cakes contract #PD769, from July 2015 through December 2019 had a contract spend of approximately $668,813.00. The State of Utah Division of Purchasing does not guarantee any purchase amount under the future awarded contract. Issuing Procurement Unit, Conducting Procurement Unit, and Solicitation Number The State of Utah Division of Purchasing is the issuing and conducting procurement unit for this IFB (referred to as âthe Stateâ). The reference number for this IFB is Solicitation #NS20-53. This solicitation number must be referred to on all bids, correspondence, and documentation submitted to the State relating to this IFB. Additional Information Bidders are prohibited from communications regarding this IFB with the conducting procurement unit staff, evaluation committee members, or other associated individuals EXCEPT the State of Utah Division of Purchasing procurement officer overseeing this IFB. Wherever in this IFB, an item is defined by using a trade name, brand name, or a manufacturer and/or model number, it is intended that the words, âor equivalentâ apply; and invites the submission of equivalent products by the Bidders. Bidders may be required to submit product samples to assist the chief procurement officer or head of a procurement unit with independent procurement authority in evaluating whether a procurement item meets the specifications and other requirements set forth in the invitation to bid. Product samples must be furnished free of charge unless otherwise stated in the invitation for bids, and if not destroyed by testing, will upon written request within any deadline stated in the invitation for bids, be returned at the bidder's expense. Samples must be labeled or otherwise identified as specified in the invitation for bids by the procurement unit. New Technology Pursuant to Utah Administrative Rule R33-12-502 the awarded contract(s) may be modified to incorporate new technology or technological upgrades associated with the procurement item being solicited, including new or upgraded: (i) systems; (ii) apparatuses; (iii) modules; (iv) components; and (v) other supplementary items. Further, a maintenance or service agreement associated with the procurement item under the resulting contract(s) may be modified to include any new technology or technological upgrades. Any contract modification incorporating new technology or technological upgrades will be specific to the procurement item being solicited and substantially within the scope of the original procurement or contract. Evaluation of Administrative and Mandatory Minimum Requirement Compliance Each bid received shall be evaluated for responsiveness in as outlined in the Utah Procurement Code. To be responsive and responsible Bidders must review and respond to the following sections of this IFB: Prerequisites, Buyer Attachments, and Questions. The Prerequisites Section contains the objective criteria that will be used to evaluate the bids, including the mandatory minimum requirements and general requirements that Bidders must certify that they have read, understand, and agree to in order to submit a bid. The Buyer Attachments Section contains the required State of Utah Terms and Conditions of the IFB, which are non-negotiable, and other applicable documents to this IFB. The Questions Section contains the questions that Bidders are required to answer in order to submit a bid. Bidders must review each section carefully. Pursuant to Section 63G-6a-606 of the Utah Procurement Code this IFB shall be evaluated by the objective criteria described in this IFB. Bids submitted must comply with the prerequisites of this IFB. Any bid that does not comply with the prerequisite and questions sections will be deemed non-responsive and will be rejected. The conducting procurement unit shall: (a) award the contract as soon as practicable to: (i) the responsible bidder who submits the lowest responsive bid that meets the objective criteria described in the invitation for bids; or (ii) if, in accordance with Subsection (4), the procurement officer or the head of the conducting procurement unit rejects a bid described in Subsection (3)(a)(i), the responsible bidder who submits the next lowest responsive bid that meets the objective criteria described in the invitation for bids; or (b) cancel the invitation for bids without awarding a contract.
