THIS IS A NOTICE OF INTENT:
The Broadcasting Board of Governors/International Broadcasting Bureau (BBG/IBB), Office of Contracts (CON) located at 330 Independence Ave, SW Washington, D.C. 20237, intends to negotiate and award a sole source contract modification to Ibrahim Al Hajaj, P.O. Box 901991, Jebel Alhusain, 35 Ibnsina St. Amman, Jordan. The Contractor is currently providing the services this action covers. The planned sole source modification will allow the Contractor to continue to provide the BBG operational, maintenance and technical support throughout the Middle East and Arabic speaking North Africa because only this Contractor possesses the capabilities to provide the services necessary for the Agency to meet its broadcasting mission in the Middle East and Arabic speaking North Africa. This contract modification will include an additional three (3) months period beginning 03/31/2015 through 06/29/2015. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. § 3304(a)(2) which is implemented at FAR 6.302-2 as follows: "When the agency's need is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for.
The BBG is currently operating twenty six (26) radio stations and five (5) TV stations in Iraq, which are critical importance to the mission of BBG. The requested services are urgently needed by BBG in order to keep the above stations on the air, while BBG finalizes a long term Contract for continued BBG broadcasting in Iraq. The situation in the Middle East today is very volatile and with this modification BBG will be able to continue to provide programming to the region. In the event that this modification is not executed and the above stations go off the air, then BBG will lose the broadcasting infrastructure that is already in place. If BBG were to lose this broadcasting infrastructure in the Middle East, it would be very costly and require additional expenditure for related services for BBG to re-establish the lost infrastructure. In addition, BBG would lose the audience that it has already established and BBG may not get that audience back. It is important that BBG have a broadcasting apparatus within the Middle East as it is a critical part of the BBG broadcast mission to broadcast in the Middle East. This broadcasting infrastructure took more than 5 years to develop and without this modification it will be lost.
This Notice of Intent is not a request for competitive price proposals. Interested firms must submit a written response that demonstrates their ability to provide the above. Also, interested firms must state how they would fulfill the requirement above and include appropriate documentation describing the number of years they have been providing such services. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information.
