THIS IS A NOTICE OF INTENT:
The Broadcasting Board of Governors/International Broadcasting Bureau (BBG/IBB), Office of Contracts (CON) located at 330 Independence Ave, SW Washington, D.C. 20237, intends to negotiate and award a sole source contract to Ibrahim Al Hajaj, P.O. Box 901991, Jebel Alhusain, 35 Ibnsina St. Amman, Jordan. The Contractor is currently providing the services this action covers. The planned sole source award will allow the Contractor to continue to provide the BBG operational, maintenance and technical support throughout the Middle East and Arabic speaking North Africa because only this Contractor possesses the capabilities to provide the services necessary for the Agency to meet its broadcasting mission throughout the Middle East and Arabic speaking North Africa. This contract will include a Base Period of one (1) year with four (4) additional one year Option Periods (08/01/2015 to 07/31/2020) that may be exercised at the Government's discretion and subject to the availability of funding. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. § 3304(f) which is implemented at FAR 6.302-1 as follows: "When the supplies or services required by the agency are available from only one responsible source ... and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
The intended Contractor is the incumbent. As a direct result of the efforts of this Contractor, the BBG is currently operating twenty six (26) radio stations and five (5) TV stations in Iraq, which are critical importance to the mission of BBG. If BBG were to lose this broadcasting infrastructure in the Middle East, it would be very costly and require significant additional expenditures for BBG to re-establish it. Also, BBG could lose the audience that it has already established and it may not be able to get that audience back. It is vital that BBG have a broadcasting apparatus within the Middle East because a critical part of the BBG's mission is to broadcast in the Middle East. In addition to the Middle East, the BBG also operates, in significant part through the efforts of this Contractor, two (2) FM radio stations in Jordan, with one (1) providing coverage into Damascus, Syria, and three (3) FM radio stations in Libya. The required services of the Contractor are also needed to keep these Arabic speaking North African stations up and running or the BBG will lose audiences in another strategic region of the world. There is no other vendor who has the required facilities available, who possesses the detailed knowledge of the Agency's broadcast network and requirements, and has contacts in the region which have greatly benefited the Agency. Based on BBG's familiarity in these areas, it is BBG's opinion that the Contractor, Ibrahim Alhajaj, is presently the only source capable of and authorized to continue the uninterrupted 24-hour FM transmissions and other broadcast operations support in the above countries required for BBG to carry out a statutorily required mission. Additionally, because the Contractor has entered into leases throughout the area allowing the placement of BBG's transmission equipment at appropriate locations, replacing the Contractor would require relocating the transmission equipment. Any attempt to relocate the transmission equipment to any other site(s) at this time would result in an undetermined length of interruption of FM broadcast support services, as well as considerable additional costs to the U.S. Government.
This Notice of Intent is not a request for competitive price proposals. Interested firms must submit a written response that demonstrates their ability to provide the above. Also, interested firms must state how they would fulfill the requirement above and include appropriate documentation describing the number of years they have been providing such services. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The written response must be submitted to Seneca Belinfontie, Contract Specialist, by Tuesday, September 3, 2015 12:00pm eastern daylight saving time via email at [email protected]. ALL ATTACHMENTS MUST BE SENT IN "PDF FORMAT" AND INCLUDE THE SOLICITATION NUMBER IN THE SUBJECT LINE. PLEASE NOTE THAT THE TOTAL SIZE OF ALL ATTACHMENTS MUST NOT EXCEED 23MB.
