Opportunity Summary SOLE SOURCE PUBLIC NOTICE Date of Public Notice: March 18, 2021 Anticipated Award Date: March 24, 2021 Description: Two speaking engagements and Question and Answer session on the 1619 Project - Speaker Nikole Hannah-Jones Prospective Contractor: The Lavin Agency, personal representative of speaker Sole Source Justification pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275, the Oregon Department of Education finds a Sole Source Contract is necessary to efficiently acquire the services for 1619 Project developer, Nikole Hannah-Jones, through her representative agent, The Lavin Agency. Background: The 1619 Project is a long-form journalism project developed by Nikole Hannah-Jones, writers from The New York Times, and The New York Times Magazine which "aims to reframe the country's history by placing the consequences of slavery and the contributions of Black Americans at the very center of the United States' national narrative". The project was first published in The New York Times Magazine in August 2019 for the 400th anniversary of the arrival of the first enslaved Africans in England's Virginia colony. The project later included a broadsheet article, live events, and a podcast. The Oregon Department of Education is engaging in professional development surrounding black history and breaking down systems of oppression in Oregon's schools. As the creator of the 1619 Project, Ms. Hannah-Jones will provide professional development to educators to 1) create a shared understanding of the experiences and backgrounds of students of color in Oregon schools; 2) provide the opportunity to educators to redesign systems while learning from other districts in this shared work; and 3) have an immediate impact on educators by assisting their understanding of how the written and shared history of our country since 1619 has omitted how black American's contribution to our country's development over the past 400 years. ODE is using the sole source method to enter into contract with The Lavin Agency, as the agency has the rights to schedule speaking and training engagements and expertise of Nikole Hannah-Jones. This sole source contract is anticipated to have a maximum compensation of $50,000. Market Research Findings Pursuant to ORS279B.075: The Contracting Officer makes the following determinations: a. Pursuant to ORS 279B.075(2)(a): - It is unlikely that such a Sole Source contract will substantially diminish competition as the efficient utilization of existing goods or services requires the acquisition of compatible goods or services; Agency finds due to the nature of this service it must depend on this Contractor identified as a sole source. b. Pursuant to ORS 279B.075(2)(d): Additional findings that support the conclusion that the goods or services are available from only one source. Contractor holds the rights to schedule and book the speaker. The Oregon Department of Education has made reasonable effort to ensure competition for this Sole Source procurement, through the use of web research and ODE program contacts and documentation. The resulting one-time contract is anticipated to be in the amount of $50,000 and will be issued according to authority of OAR 125-247-0275 with reasonable effort made to ensure competition. Protestors of this procurement must file a written protest to Sonja Svenson at [email protected] by 4:30 PM March 24, 2021. The written protest must include: (1) A detailed statement of the legal and factual grounds for the protest; (2) Evidence or documentation supporting the grounds on which the protest is based; (3) A description of the resulting harm to the Affected Person; and (4) The relief requested.
