The Naval Medical Center San Diego (NMCSD) intends to award a firm fixed price sole source purchase order under the authority of FAR 13.106-1(b)(1)(i), due to only one source being available to meet the Government's needs, to:

The objective of this sole source award is to procure Service Maintenance for base year plus 4 option years on Government owned equipment listed below:

The requirement is for Service Maintenance on two (2) Cerus Intercept Illuminators are pathogen reduction systems that reduces or eliminates pathogens that potentially reside in a unit of platelets. By using ultraviolet light and specific chemicals the process destroys pathogens such as bacteria that could be transfused to a patient. The contractor is required to provide all services, materials and equipment necessary for the repair/preventive maintenance of both Cerus equipment. The scope of work performed under these specifications includes the furnishing of all labor, and parts to perform all repairs on equipment to assure continued operation at their designed efficiency and capacity.

Cerus Corporation is the only source that provides service maintenance for the listed Government owned equipment that meets the requirements identified herein due to the proprietary nature of this equipment, no other company was found that could access the equipment to provide maintenance should a problem arise. Cerus Corporation has patent rights and proprietary ownership of their products, parts, services and does not authorize third party service dealers or retailers to service or resell their equipment of parts. Additionally, parts utilized in repairs are Original Equipment Manufacturer (OEM) parts/components in order to ensure maximal function and that liability and warranty on devices are intact.

This notice of intent is not a request for competitive proposals and no solicitation document exists for the requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to perform the required work. Capability statements shall not exceed 5 (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order.
