THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION DOCUMENT WIL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute of Environmental health Sciences (NIEHS), Research Triangle Park, NC intends to negotiate and award a purchase order on a noncompetitive sole source basis with AB Sciex LLC, 110 Marsh Drive, Foster City, CA 94404-1162, pursuant to 41 U.S.C.253 (c)(1)—Only one responsible source and no other supplies or services will satisfy agency requirements. This procurement is for one (1) each of the following items: Maintenance Agreement Renewal for 4800 Maldi TOF/TOF/Analyzer, serial #AK12820808. This instrument is comprised of multiple patented components and proprietary software applications, providing high resolution of proteins with sensitivity, selectivity, and reproducibility across a wide range of applications and sample types. This service will provide parts and proprietary software, which includes proprietary source algorithms necessary for proper instrument operation. The expected effective date for the award is 1/25/2012-1/24/2013. Interested parties may identify their interest and capability. Respond to this requirement by submitting written capabilities / specifications to the Contracting Specialist at the address stated below. A determination by the Government not to compete this proposed contract action based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered for the purpose of determining whether to conduct a competitive procurement. If no affirmative responses are received within ten (10) days of this notice to determine whether a qualified source is more advantageous to the Government, an order will be placed with AB Sciex, LLC. The NAICS Code / Size is 811219 / 7.0 M and is not a small business set aside. The acquisition is being conducted under FAR Part 13, Simplified Acquisitions Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable and the resultant purchase order will include all applicable provisions and clauses in effect through the Federal Acquisitions Circular (FAC) 2005-55(January 3, 2012). Interested parties may identify their interest and capabilities in response to this synopsis by January 23, 2012 at 9:00 am Eastern Standard Time. The determination by the Government not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government.
