SUBJECT
A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL)

The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation.

PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011)
This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award.

HOW TO APPLY
Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. Offerors shall ensure their resume demonstrates their possession of the minimum qualifications outlined in this Solicitation, as well as their ability to fulfill all required duties. The Government is not responsible for any costs incurred by the offeror during the solicitation process.

GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT
The Bureau of International Narcotics and Law Enforcement Affairs (INL) is part of the Under Secretariat for Civilian Security, Democracy, and Human Rights (J) within the Department of State (DOS). INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens by providing effective foreign assistance and fostering global cooperation.

INL's Office of Africa and the Middle East (AME) develops and manages criminal justice sector reform programs and contributes to policy formation on civilian security issues in both regions. INL/AME and INL personnel in the U.S. Mission administer U.S. government assistance to Somalia in order to develop its criminal justice sector, reform its security sector, and disrupt transnational organized crime.

The purpose of this Personal Services Contract is to backill fill the position of an INL/Somalia Senior Criminal Justice Advisor ("Advisor") at the U.S Mission to Somalia, currently located at Embassy Nairobi ("U.S. Mission"). The INL Advisor will provide specialized criminal justice expertise to develop the INL program in Somalia, in coordination with INL/AME, and oversee all management aspects of the program (to include funding, training, equipment accountability, and implementer performance). The INL/Somalia Advisor also will provide internal controls and accountability for the delivery of equipment, technical assistance, training, and other assistance to Somalia under the INL program and other duties as assigned. The INL/Somalia Advisor must be able to work rapidly, responding promptly to multiple and evolving priorities in a difficult and demanding environment. The position requires criminal justice sector subject matter expertise and programming experience to enable the incumbent to determine swiftly what assistance is required, within what timeframe it must be implemented, and how such assistance must be supervised to ensure its effectiveness. Frequent travel to Somalia will be required as conditions allow. INL and U.S. Mission intends to relocate this position to Mogadishu full-time in the future when conditions allow.

The INL/Somalia Advisor will provide general administrative and policy guidance concerning overall INL program priorities and objectives for Somalia, as well as work with INL/AME to develop and manage programs and related issues. The INL/Somalia Advisor will liaise with other U.S. agencies and governments active in the criminal justice field and with host government contacts. The INL/Somalia Advisor will monitor INL programs in Somalia, analyzing their effectiveness and suggest improvements. S/he will present these approaches to INL/AME and the Mission for discussion and final approval.

DUTIES AND RESPONSIBILITIES
• Identifies opportunities for effective criminal justice sector programs in Somalia that will fulfill INL's goals and objectives, including law enforcement support, prosecutorial reform, transnational organized crime, rule of law, counternarcotics, anti-corruption, anti-moneylaundering, and countering the financing of terrorism, as appropriate. Works with INL to help develop, implement, and monitor criminal justice programming for Somalia, to include but not limited to reviewing project proposals, working on program budget, meeting with implementing partners, and taking stock of what other donors are doing in-country.
• Assesses and advises mission leadership and INL regarding the performance of Somali agencies and INL implementing partners to recommend future criminal justice programming in Somalia.
• Coordinates and liases with Somali officials and draws on subject matter expertise to determine best practices to develop institutions, including the police, the judiciary, the corrections system, and civil society. Generates support for and actively advances U.S. policy objectives with key host government officials. Acts as liaison between these entities and components of the U.S. Mission.
• Develops and maintains excellent professional relationships with host government criminal justice sector officials to ensure close, cooperative working relationships.
• Assists in the preparation of required reporting such as the annual budget request for International Narcotics Control and Law Enforcement (INCLE) funds and the Mission Resource Request. Coordinates and prepares annual reporting requirements for INL (e.g., the End-Use Monitoring Report, etc). Helps administer and monitor the expenditure of funds provided to implementers. Prepares program documentation and procurement requirements for criminal justice assistance projects. Helps prepare regular reporting, including monthly status reports, to INL/AME.
• Analyzes and reports regularly on law enforcement and justice sector developments in Somalia, ensuring that the USG is fully informed on the capabilities, capacity, performance, and opportunities with regard to all elements of Somalia's justice sector.
• Briefs Department, Congressional, and other international dignitaries orally and in writing on the INL-funded criminal justice programs in Somalia. In coordination with INL/AME, prepares documents for presentation to the U.S. Congress. Develops appropriate itinerary and accommodates official travelers, as directed.
• Establishes and maintains appropriate internal management control systems. Ensures that INL programs are not subject to waste, fraud, or mismanagement. Helps manage and monitor the use of all U.S.-provided commodities intended for criminal justice sector purposes.
• Conducts senior-level field surveys, evaluations, and special studies, as directed.
• Maintains security awareness and properly handles classified and controlled items and information.
• Serves as the Contracting Officer's Representative and/or Grants Officer Representative for INL/Somalia projects as directed.
• Supervises and manage in-country INL staff at the U.S. Embassy, including but not limited to locally-employed staff (LES) and third party contractors (TPC). Provides guidance to and works closely with one Eligible Family Member (EFM). Provides oversight and guidance to INL implementers and contractors as necessary.
• Coordinates with the INL EFM and other Mission staff to ensure that necessary Leahy vetting for INL training recipients is completed.

TRAININGS & DISTANCE LEARNING COURSES
1. Completes the Contracting Officer Representative (PA296) and Grants Officer Representative distance-learning (DL) courses through the Foreign Service Institute (FSI), as necessary, within 90 days of arriving at Post.
2. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first two (2) months of arriving at Post.
3. Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post.
4. Completes INVEST training.

RELATIONSHIP
The INL/Somalia Advisor will report to the Political/Military Chief in the U.S. Mission to Somalia. S/he also will receive additional guidance from, as well as liaise and coordinate with INL staff in Washington, DC.

The Political/Military Chief will provide yearly performance reviews to the INL/AME Africa Team Lead in Washington, DC to contribute to the incumbent's official yearly performance review.

The INL/Somalia Advisor will reside in Nairobi until such time that the position is relocated to Somalia. However, frequent travel and work in Somalia will be required as circumstances dictate and the security situation allows.

COMPLEXITY
The work involves managing and providing technical expertise on a number of different assignments to various offices and stakeholders. The ability to perform complex analysis and communicate well is essential in coordinating with other agencies/governments active in the fields of criminal justice sector reform, rule of law, and administration of justice, as well as with host government contacts.
SCOPE AND EFFECTIVENESS
The INL/Somalia Advisor will perform broad and extensive assignments related to a complex administrative/financial programs spanning the full-range of INL program activities and objectives (e.g., citizen safety, law enforcement, rule of law, and counternarcotics) in a very dymanic and complex environment.

MINIMUM REQUIREMENTS
1. U.S. citizenship and the ability to obtain and maintain Department of State Top Secret and Medical Clearances, may start with an interim Top Secret clearance.
2. Graduate degree from an accredited institution, and prior work experience in the area of law, international development, international affairs, criminal justice, global security, political science, or a related field.
3. Five (5) years of experience managing international development or criminal justice and security assistance programs.
4. Demonstrated experience in:
• Developing and managing long-term rule of law or law enforcement programs, including assessment, monitoring and evaluation;
• Drafting related reports/documents, budgets, and strategic plans related to foreign assistance programs;
• Planning, strategizing, implementing and reporting on projects;
• Drafting analytical briefing papers, memoranda, letters, and reports for review or signature by senior-level officials; and
• Coordinating and working closely with the Department of Defense, United Nations or international community on security sector development programs.
5. Proven ability to work effectively with host-nation counterparts, departments, and ministries to further program objectives, in a timely and concise manner.
6. Demonstrated ability to work within an embassy setting and effectively with other U.S. agencies.
7. Demonstrated ability to manage multiple tasks in a timely manner in a fast-paced environment.

GOVERNMENT-FURNISHED EQUIPMENT
The PSC shall work out of the U.S. Mission to Somalia, currently based in Embassy Nairobi. S/He will have access to office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State.

TRAVEL REQUIREMENTS
The position is based full-time in Nairobi, Kenya with frequent travel to Somalia as conditions allow. INL and U.S. Mission intends to relocate this position to Mogadishu full-time in the future when conditions allow.

EVALUATION FACTORS

Factor 1: Program Management 40 points
Demonstrated experience in program management, especially in international programs involving multiple agencies that include foreign government entities; to include experience involving analytical, planning, management, advisory, operational, or evaluative duties.

Factor 2: International Experience 25 points
Demonstrated experience managing international programs (preferably in East Africa); to include the ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations.

Factor 3: Past Performance 20 points
Past Performance of applicant's ability to perform duties assigned related to the position. (Evaluator may use all evaluation information available at the time of the evaluation, whether provided by the applicant or obtained from references or other sources).

Factor 4: Communication 15 points
Demonstrated ability to communicate effectively, both orally and in writing, in a timely and concise manner, and to interact effectively with others at all levels, in order to prepare, analyze, explain and defend determinations and requirements with respect to conformance to applicable laws, policies and other regulatory guidelines, and advise program officials.

The most qualified candidates may be interviewed, required to provide a writing sample, and demonstrate an ability to operate commonly used office applications. INL will not pay for any expenses associated with the interviews. In addition, applications (written materials and interviews) will be evaluated based on content as well as on the applicant's writing, presentation, and communication skills. In the event that a candidate has fully demonstrated his/her qualifications and there are no other competitive applicants, INL reserves the right to forego the interview process. Professional references and academic credentials will be evaluated for applicants being considered for selection.

COMPENSATION (BASE PAY)
For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
