DESCRIPTION:
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Bruker BioSpin Corporation located at 15 Fortune Drive in Billerica, Massachusetts to purchase the repair of a cryoprobe for a NIST owned Bruker Nuclear Magnetic Resonance(NMR) Biospin machine.
National Institute of Standards and Technology researchers operating at the Hollings Marine Laboratory in Charleston, SC, utilizes a Bruker Biospin 700 MHz AVII NMR (nuclear magnetic resonance) instrument in current studies. One of the Bruker cryoprobes used within this instrument has failed and is in need of repair - model number CP TCI 700S4 H-C/N-D-05 Z, serial number Z44908/00029.
The sole source justification is based on the following: Bruker is the original manufacturer of this equipment and is the only source reasonably available with the proprietary technical capabilities to fulfill this service. Bruker is the sole provider of certified service engineers and facilities that are capable of providing authorized repairs for this cryoprobe. Bruker does not have any authorized repair partners who have access to the proprietary technology, tools, and procedures required to repair the cryoprobe.
Given these facts, Bruker Biospin is considered the only source reasonably available to provide the required service.
The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 811219 with a size standard of 20.5M.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 11:00 am EST 05 March 2017, will be considered by the Government.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
