This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT


The Department of Labor, Office of Occupational Safety and Health Administration (OSHA) Salt Lake Technical Center located in Sandy, Utah, intends to award a sole source contract, to Panalytical Incorporated, Westborough, MA 01581.

Purchase Description: Emergency repairs and modifications TO the Panalytical XRD Instrument. The repairs and modifications permit the machine to fine tune analysis to support citations under the new silica rule.

The associated North America Industry Classification System (NAICS) Code is 811219 and the Business Size Standard is $2.5M. The government intends to award a firm fixed price, contract to Panalytical Incorporated, 117 Flanders Road Westborough, MA 01581 in accordance with FAR 6.302-1, Only One responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

The resulting contract is for a firm fixed price service. The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1.

Interested persons may identify their interest and capability to respond to the requirement or submit proposal. Written responses to this notice shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. All interested sources may submit a proposal which will be considered by the agency for future purposes.

This is not a request for competitive proposals and the Government does not intend to pay for information received. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.

All responses received within 3 days after date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Interested persons may identify their interest and capability to respond to the requirement no later than 4:00 P.M. Eastern Time September 16, 2016. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
