THIS OPPORTUNITY IS AVAILABLE ONLY TO THE EXISTING EPA CONTRACT-HOLDER THAT HAS BEEN AWARDED A LEAKING UNDERGROUND STORAGE TANK (LUST) REMEDIATION IN INDIAN COUNTRY CONTRACT (EP-W-07-104)

The purpose of this Work Assignment is to obligate $5,000.00 for the eligible tribal LUST Hotevilla-Perry Sehongva's Hopi Tribe (HOPI 037) project. The period of performance for this work is from January 7, 2010 to September 28, 2011. Site activities may include the verification of the existence of a UST system (geophysical investigation), sampling and analysis of soil and potential groundwater, if encountered. In addition, all UST's associated piping and other related equipment shall be removed from the site to facilitate adequate sampling. Between 15 to 20 cubic yards of soil may be removed from this site. Soil samples and or groundwater samples may be needed to further assess the site even without the removal of the UST system. This work assignment may be amended with additional funding for additional site assessment activities, if necessary. The site is located on Hopi Tribe Trust Land near Hotevilla, Arizona in Navajo County.

The American Recovery and Reinvestment Act (ARRA) contains specific acquisition requirements that must be met when using appropriated funds from the Act, including the need for acquisitions to be in accordance with the FAR and, to the maximum extent practicable, awarded as fixed-price (FP) contracts using competitive procedures. However, the Office of Management and Budget's guidance allows for the use of other than FP contracts. Although the Agency's Office of Underground Storage Tank (OUST) contracts were not awarded as FP contracts, each contract structure was selected to provide the contractor with the greatest incentive for efficient and economical performance, given the types of services to be performed. The existing OUST contracts have sufficient qualified acquisition personnel to provide appropriate contract administration and oversight to monitor contract performance to mitigate the Government's risk. In order to meet the requirements of the Act in the most prudent business manner within the time constraints imposed, existing OUST contracts are the most appropriate contractual vehicles consistent with Agency plans that promote the goals of the ARRA.
