The Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA) (P.L. 108-173) amended section 1847 of the Social Security Act to require to CMS to establish a competitive bidding program as a permanent part of Medicare. Section 302 of the MMA authorized CMS to implement the DMEPOS competitive bidding program using a contractor. The Centers for Medicare and Medicaid Services (CMS) intends to award a 5-year Firm Fixed Price contract, with a performance period of one base year and four one-year options. This contract is to assist CMS with the implementation of the competitive bidding program for certain durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) items and services.
