NO PREFERENCE PROGRAM LISTED. The Offerors are required to be from the geographical areas are Arizona, Colorado, Nevada and New Mexico for this solicitation. At the Bureau of Indian Affairs, Ute Mountain Ute Agency, Court of Indian Offenses, CFR Court, Ute Mountain Ute Tribe, Towaoc, Colorado, Chief Magistrate will: (1) Preside over the civil, criminal and juvenile dockets, (2) Make judgments and decisions based on the Federal rules of civil, criminal and evidence procedures for magistrate courts, the Ute Mountain Ute Tribe’s penal, civil and children’s codes, customs/traditions of the Ute Mountain Tribe, (3)Be responsible for the general administration of the contract, including submitting reports and invoices. (4)The Chief Magistrate be required to attend and participate in training seminars, workshops and conferences that directly relate to the chief magistrate services, The Contracting Officer may authorize attendance at similar activities sponsored by other judicial organizations, (5) Establish a work schedule, which will include time for judicial service, administrative matters, research, conferences, library time and to conduct hearings at the Court of Indian Offenses, Ute Mountain Ute Tribe (Colorado). Work schedule to be coordinated with the COR, Court Clerk and Court Administrator, (6) Attend to administrative functions after regular work day when required by the Court of Indian Offenses, Ute Mountain Ute Tribe (Colorado), procedures to issue search warrants and telephone arraignments, (7) Provide current contact numbers and addresses, i.e., telephone, facsimile, e-mail, home, and cellular phone to the COR. The information will be given to the Court of Indian Offenses, Ute Mountain Ute Tribe (Colorado), Court Clerk, Ute Mountain Ute Agency Superintendent, and Law Enforcement Chief, (8) Notify the Court of Indian Offenses, Ute Mountain Ute tribe (Colorado) Court Clerk no less than thirty-four (34) hours when scheduled absences will occur and by 9:00 AM of the day an unexpected absence occurs, (9) Research Court of Indian Offenses court cases, Tribal Ordinances, Code of Federal Regulations, Federal law, State of Colorado law, State of Utah law, tribal customs/traditions and other authorities that would apply to cases before the court, (10)Shall work a maximum of thirty four 34-hours per week, will perform Chief Magistrate duties and work with Court of Indian Offenses, CFR Court, Ute Mountain Agency. (Qualifications: (a) Have a minimum of two years experience in actual practice and litigation experience in general civil and criminal law and actual practice within three years. (b) Have a current license to practice law, (c) Have a current working knowledge of Indian and tribal law, the Code of Federal Regulations, Federal law, State of Colorado law and State of Utah law, (d) Pass a background check), (11) Background investigation is required for this position, according to the P.L. 101-630, Indian Child Protection and Family Violence Prevention Act of 1990: P.L. 99-570, Indian Alcohol and Substance Abuse Prevention and Treatment Act of 1986; and P.L. 101-647, Crime Control Act. The CFR Court services the Ute Mountain Ute Tribal members in Towaoc, Colorado and White Mesa, Utah. The CFR Court is located in the community of Towaoc, Colorado on the Ute Mountain Ute Indian Reservation located in Southwest Colorado and Northwest New Mexico. Towaoc is the Ute Mountain Ute Tribal headquarters and located 12 miles south of Cortez, Colorado, on Hwy 666. The CFR Court location address is 203 Sunset Blvd., Towaoc, Colorado 81334. No residential or rental housing is available in Towaos. The nearest available housing is in Cortez, Colorado or Blanding, Utah. The current population of Towaos and White Mesa is estimated to be 1,632 people of which 1343 reside in Towaoc and 289 in White Mesa. The approximate percentage of the estimated population is: 87% Tribal Members, 11% Native American non-tribal members, and 2% Non-Native American.
