The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis under the authority of FAR 13.106-1(b)(1) Soliciting from a Single Source with Quo Data Gesellschaft Fur Qualitatsmanagement und Statistik, Dresden Germany for annual renewal of PROLab Plus Fullsite licenses, PROLab Plus customization, and access to the PROLab_HUB web service used to collect, evaluate, and distribute data obtained as part of interlaboratory comparisons (ILCs) and quality assurance programs (QAPs). This is a sole source inasmuch as Quo Data developed the PROLab Plus software and accompanying tools, and the PROLab_HUB web application and accompanying tools and distributes both exclusively. Access to the PROLab_HUB platform is not available on-line through any other interfaces or vendors. Quo Data owns and controls intellectual proprietary rights associated with the licensed content attributed to PROLab Plus and PROLab_HUB. Licenses of PROLab Plus and PROLab_HUB can only be acquired through Quo Data. A firm fixed-price purchase order will be negotiated and issued on or about 16 Apr 2024. No solicitation package will be issued. This notice is not a request for competitive proposals; however, interested parties may identify their interest and capability to respond to the requirement. Inquiries will only be accepted via e-mail to [email protected]. The government will consider responses received by 5:00PM, EST, 1 Apr 2024. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill the requirement. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. This notice of intent is not a Request for Quotation (RFQ) nor is it a request for competition. No telephone requests will be honored.
