U.S. Customs and Border Protection (CBP) intends to negotiate on a sole source basis, with Thermo-Electron North America LLC the procurement of one (1) each DXR 780 NM High Brightness Excitation Laser.  The replacement laser will be install into the DXR Smart-Raman Spectrometer at the U.S. Customs Services Chicago IL Laboratory.

Market research determined that Thermo-Electron North America LLC is the only source that's capable of providing the replacement laser due to the uniqueness of the firm, fix and function specifications required for proper operation of the DXR Smart-Raman Spectrometer.

Sole Source Justification:  This purchase will be made under Simplified Acquisition Procedures and Other Than Full and Open Competition as authorized by FAR 13.106 and FAR 13.501. This notice of intent is not a request for competitive proposal. The anticipated award date is on or before 17 August 2017.

Please note that instant acquisition for a replacement DXR 780NM Laser is not a solicitation for competitive proposals. If any interested parties believe they can provide the required replacement Laser, they must submitted a written statement of capabilities containing sufficient details to allow the Government to determine if the parties can provide the required item.  The Government will not be responsible for any costs incurred by the parties in their preparation of a response to instant announcement.

Written capabilities statement from interest parties shall be limited to a maximum of three (3) pages, single-spaced, 11 or 12 font size (only), folder-outs and graphics/depictions shall be considered inclusive of the page count.  Capabilities statement shall be submitted via email to [email protected]; prior to 2:00 PM EST on 25 July 2017.

No award will be made on the basis of any proposal or other information received in response to this notice; as this is a notification of intent to acquire services/supplies and not a request for proposals.  This is the only notice that will be issued for the services/supplies (replacement laser).

A determination by the Government not to compete this requirement shall be based on responses to this notice and is solely within the discretion of the Government.  Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
