The Naval Air Warfare Center Aircraft Division, Lakehurst, NJ intends to negotiate a sole source procurement with Diagnosys Systems, Inc., Westford, MA for seventy-one (71) Software Licenses (P/N TVUE-SWLS-12) and ten (10) PinPoint IIR Electronic Circuit Test Sets (P/N: NP2R-14144-01), which includes a three-year warranty and with Diagnosys Systems, Inc., Westford, MA. This requirement will also include optional CLINs for 2 CONUS and 1 OCONUS onsite trainings (P/N P2-OST) at three separate locations. It is anticipated that this contract will be Firm Fixed Price.

The Navy intends to procure this effort under the authority of 10 U.S.C 2304 (C)(1), as implemented by FAR 6.302-1 , "only one responsible source and no other supplies or services will satisfy agency requirements.". These items and services are offered commercially by Diagnosys Systems and as the designer and manufacturer, they are the only source with the necessary rights in data to fulfill the Governments requirement. A solicitation is not available for his procurement. This notice of intent is not a request for competitive proposals. However, the Government will consider all responses received within fifteen days after the date of publication of this synopsis. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Information received as a result of this notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
