Amendment 1 attached on 04/12/2023. The following questions were recieved:
- Page 2, it appears the header of the RFQ includes a reference to a prior requirement, “RFQ NO. RFQ0000497 – Furniture Training Aides for Live Shoot House Facilities” which we consider a typo.
- TAA/BAA compliance: our HW is offered as COTS thus except from TAA by default as BAA doesn’t apply. Could you please clarify the applicability or if it can be removed?
- Congress has exempted commercial-off-the-shelf (“COTS”) products from the “substantially all” requirement, 41 U.S.C. § 1907, so a COTS product “manufactured” in the United States is BAA-compliant even if it is manufactured from predominantly foreign components, FAR § 25.101(a)(2).
- Page 8, 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items: could you please uncheck or confirm the following clauses do not apply to the subject RFQ for COTS products being exempt:
- 52.225-1, Buy American-Supplies (May 2014) (41 U.S.C. chapter 83).
- 52.225-5, Trade Agreements (OCT 2019) (19 U.S.C. 2501, et seq., 19 U.S.C. 3301 note).

Answer 1: Yes, the header was a typo and has now been corrected to state RFQ0002156.
Answer 2 & Answer 3: The two FAR clauses listed below have been unchecked are not applicable to this RFQ:
