(16) Description:

The Defense Logistics Agency (DLA), also referred to as the Government, intends to post an unrestricted, Firm Fixed Price (FFP) solicitation to SAM.gov for a Lowest Price Technically Acceptable (LPTA) acquisition for the mining, processing, and delivery of up to 172 metric tons of 75% Nd2O3 - 25% Pr6O11 (“NdPR Oxide”). All NdPr Oxide to be delivered under any resulting contract shall be packaged and delivered using UN 1A2 “X” rated drums. This procurement will additionally require sampling of the NdPr Oxide to be performed by an independent sampling subcontractor and testing of the NdPr Oxide to be performed by an independent testing laboratory subcontractor. Any eventual contract award will require the Contractor to deliver the material to Hawthorne, Nevada.

DLA intends to solicit this acquisition on an ‘other than full and open competition’ basis in accordance with FAR 6.302-3. **Accordingly, all NdPr Oxide shall be sourced (i.e., mined) and processed exclusively in the United States, its outlying areas (i.e., United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands), or Canada.** The Justification and Approval for Other Than Full and Open Competition (“J&A”) is included with the posting of this synopsis.

The period of performance will be 12 months from the time of award.

The applicable PSC is 9620 and the applicable NAICS is 325180 (Other Basic Inorganic Chemical Manufacturing, small business size standard of 1,000 employees or less).

This requirement will be procured under the guidelines of FAR Part 12, Commercial Items.

Only proposals submitted from offerors registered in System for Award Management (SAM) will be considered for award under any resulting solicitation. In order to be eligible to receive an award under any resulting solicitation, an offeror must have a Unique Entity ID which may be acquired through SAM registration.

All responsible sources may submit a proposal which shall be considered by the Government.

(17) Place of Contract Performance:

Performance locations are restricted to the United States, its outlying areas (i.e., United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands), or Canada. The Contractor shall deliver the NdPr Oxide to the Hawthorne Army Depot, Hawthorne, Nevada.
