FAR 6.302-1(a)(2) requires an ordering activity to justify its actions when restricting consideration of contractors to "only one source and no other supplies or services will satisfy agency requirements". The specific circumstances that justify restriction for this acquisition is FAR 6.302-1(a)(2), “When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”, and FAR 6.302-1(c)(1), " An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer." The execution of this effort will be a new Firm-Fixed Price (FFP) contract solicited via beta.SAM. The anticipated period of performance of the order is to be from 1 September 2020 - 31 August 2021. Clause by Reference: DFARS 252.232-7006, WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS. ADDENDUM TO FAR 52.212-4 AFFARS 5352.201-9101 OMBUDSMAN (JUN 2016)(IAW AFFARS 5301.9103) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b)Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
