The 37th Contracting Squadron intends to issue a sole source firm fixed priced purchase order to Medtronic Endovascular, 710 MEDTRONIC PKWY Minneapolis, MN 55432-5604, for the purchase of Talent Thoracic Stent Grafts.
The justification for this procurement is that MEDTRONIC ENDOVASCULAR is the sole source and the current provider of these stents. It is to the advantage of the Government to continue the purchase from this company for the continuation of ready availability of the product for scheduled surgeries. This product is a direct match to the equipment utilized during surgery. Medtronic Endovascular is an approved vendor for unique graft sizes for traumatic thoracic vascular aneurysms. The acquisition of this specific product from this vendor will substantially reduce the risk of substandard patient care and limit the Government's potential liability in instances of substandard care. The statutory authority permitting other-than-full-and-open competition is 41 U.S.C., 253(c) (1): FAR 6.302-Only one responsible source at this time will satisfy agency requirements. A determination by the Government not to compete this proposed contract will be based on responses to this notice and is solely within the discretion of the Government. Information received will be considered solely for informational purposes. This procurement is not set-aside for small business and the intent of this procurement is to award based on ready availability and cost.
The proposed contract action is for commercial items which the Government intends to solicit and negotiate with only one source under authority of FAR subpart 27.4. The anticipated award date is November 13, 2009.
