The Federal Communications Commission (FCC) intends to purchase a sole source subscription with LexisNexis. The proposed effort will provide the FCC's library with an online Subscription to LexisNexis/Matthew Bender Collection to provide continued updates to our print legal titles as published by LexisNexis/Matthew Bender. These titles include but are not limited to: Michie’s Annotated Code of Maryland, Moore’s Federal Practice Guide, Entertainment Industry Contracts, US Code Annotated, and Nimmer on Copyright. As changes in the law occur, it is imperative that the FCC resources remain as up to date as possible. This subscription will provide updates to the LexisNexis/Matthew Bender titles currently held in the FCC library and replace any books that become outdated. The LexisNexis/Matthew Bender publications that the library subscribes to are the most authoritative title on that subject. Because the LexisNexis/Matthew Bender updates are unique to LexisNexis/Matthew Bender publishers and no other vendor supplies updated content to those titles, the library has no choice but to sole source this subscription. The period of performance for this effort is one base year, beginning 9/30/2017 through 9/29/2018. There are no option years.

This notice of intent is not a request for proposals or quotations. The authority for negotiating a sole source basis is made under 41 U.S.C. 253 (c) (1) and FAR 13.106-1 which permits soliciting from a single source, if the contracting officer determines that the circumstances of the contract action deem only one source is reasonably available. Any challenges to this sole source requirement must be received by September 15, 2017 NO later than 12:00PM, Washington D.C. local time, in writing, and sent to [email protected] and [email protected] in order to be considered by the Government for the purpose of determining whether or not to compete the requirement.

Challenges must include information sufficient to enable the Government's needs as stated herein. A determination by the Government not to compete this proposed requirement based on responses to this notice is solely within the discretion of the Government.

The FCC has already identified that there are no other capable sources, and the FCC will issue a Firm-Fixed Price Purchase Order to LexisNexis, 9443 Springboro Pike, Miamisburg, OG 45342.
