The U.S. Securities and Exchange Commission (SEC) intends to negotiate on an other than full and open competitive basis with Caen Engineering, Inc. for twenty (20) RAID Tower Enclosures, which are needed to forensically image and store large data collections obtained under subpoena from corporate entities during active investigations. Caen Engineering is the only source that has been identified as capable of satisfying the SECâs requirement because this hardware must be compatible with other subsystems. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (1), implemented by FAR 6.302-1(a) (2) â Only one responsible source and no other supplies or services will satisfy agency requirements. The SEC intends to award a purchase order to Caen Engineering on or about August 8, 2008. The value of the award is expected to be below the simplified acquisition threshold. This notice is not a competitive request for proposals. A competitive solicitation will not be issued and no further information will be provided. However, the government will give consideration to interested parties that identify their interest and capability to respond to the requirement or submit proposals by the response date of this notice.
