The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Acquisition Division-Kansas City office intends to award, on a sole source basis, under the authority of FAR 13.106-1(b)(1), with Nortek USA Inc. for repair services for a Aquadopp Profiler for the NOAA National Ocean Service located in Chesapeake, VA. 

A Sources Sought notice was posted on the Federal Business Opportunities (FBO) website on March 16, 2018 and closed on March 26, 2018.  No responses were received. 

Justification for Sole Source 

The requested repair services are provided by Nortek USA Inc. based on the company is the sole designer, manufacturer and distributor Aquadopp Profiler and currently holds all proprietary rights to the software and hardware design of the product.  The Aquadopp Profiler will assist the National Ocean Service to provide operational TAO flux buoys for scheduled ocean research projects.
