This is a notice of intent to award a sole-source purchase order and is not a request for competitive proposals. The Centers for Disease Control and Prevention (CDC), NCEZID hereby announces its intent to solicit and enter into a contract with Nikon Instruments, Inc., 1300 Walt Whitman Road, Melville, NY 11747 for the procurement Nikon Ni-U microscopes.

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) as cited in FAR 13.106-1(b)(1)(i). The Nikon Ni-U microscope has the ability to be controlled and the images viewed remotely which is important to the branch's BSL-3 work with high consequence pathogens. The combination of motorized nosepiece, motorized epi-fluorescence cube turret and motorized shutter is essential in the BSL-3. This microscope has expandable options in addition to the needed phase contrast, DIC, confocal and fluorescent capabilities. A local service representative will train lab staff and perform maintenance as required

The NAICS code for this acquisition is 333314 and the small business size standard is 500 employees. Award will be made using Simplified Acquisition Procedures found in FAR Part 13.

The Government will review any/all capabilities statements and pricing information submitted and determine if other qualified sources do exist that could provide this requirement. Information received in response to this announcement will be used solely for the purpose of determining whether to conduct a competitive procurement for these services and/or supplies in the future.

This notice of intent is not a request for competitive proposals, however, the Government shall consider all responses received within three (3) days of this posting, in accordance with FAR 5.203 (A)(1). If no affirmative responses are received within three (3) days, negotiations will be conducted with Nikon, Inc. as the only source and a contract will be issued without any additional notices being posted.

A determination by the CDC not to compete this proposed contract, based upon responses to this notification, is solely within the discretion of the Contracting Officer.
