REGULATORY AUTHORITY
The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-87 dated April 6, 2016.
This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold.
STATUTORY AUTHORITY
This acquisition is conducted under the authority of the authority of FAR Subpart 13.106-1.
DESCRIPTION OF REQUIREMENT
Purpose and Objectives
The purpose of this procurement is acquisition of FEI Company maintenance support services for a FEI Company Tecnai Transmission Electron Microscope 12BT (Serial No. D347) owned by the National Institute on Drug Abuse (NIDA) Intramural Resarch Program (IRP) Electron Microscopy Core. This equipment requiring maintenance is proprietary to its original equipment manufacturer, FEI Company. To ensure standardization of NIDA IRP data, only service, and associated parts and labor, from FEI Company are acceptable.
Period of Performance
The required periof of performance is 04/14/2016 - 04/14/2017. A firm fixed price purchase order is anticipated.
Project Description
Speciafically, the NIDA IRP Electron Microscopy Core requires the following maintenance support:
1. The contractor shall provide a Preferred 48 Hours Service Agreement for the Tecnai Transmission Electron Microscope 12BT (Serial No. D347).
2. The contractor shall provide for all labor, parts, travel, and any additional efforts associated with this service agreement.
To ensure continuity of science and continued full function of owned proprietary equipment, only FEI Company service is acceptable.
CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION
The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specificially, FEI Company is the original equipment manufacturer (OEM) of the Tecnai Transmission Electron Microscope requiring service and the equipment is proprietary to the company. As such, only FEI Company is authorized to provide service and parts for the equipment requiring maintenance. Use of any other contractor would place quipment integrity in jeopardy which would then risk continuity of science; should the equipment not remain fully functional to original equipment manufacturer standards, standardization of NIDA IRP longitudinal research study data would be jeopardized and any loss of this data would be to the serious detriment of the NIDA mission. Accordingly, only FEI Company is capable of providing the required maintenance support services.

THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov."
A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
