NOTICE OF INTENT TO SOLE SOURCE AND BRAND NAME JUSTIFICATION In accordance with FAR 6.302-1(a)(2)(ii), the Federal Systems Integration and Management Center (FEDSIM) announce its intentions to award a sole source award under the Commercial Simplified Acquisition Procedures (SAP) with Intelligent Search, Inc., 445 Hamilton Avenue, Suite 608, White Plains, NY 10601-1827. The statement of work for this effort can be obtained via email to [email protected]. THIS IS NOT A SOLICITATION OR A REQUEST FOR OFFERS. This is a Notice of Intent. Brand Name Justification-This procurement will also be awarded in accordance with FAR authority FAR 6.302-1. Reason for citing authority: The specific section of CICA allowing this action is set forth under 41 U.S.C. 253 (c) (1) as implemented under FAR 6.302-1(a) (2)(ii). The existence of limited rights in data, patent rights, copyrights, or secret processes make the supplies and services available from only one source. Department of State, Verification and Compliance Bureau (VC/VO) uses NameSearch software to search for information using different variations on search elements. This supports the arms transfer licensing process of the Compliance Office within the Directorate of Defense trade controls. The software requires upgrades and updates for necessary patches, along with technical support. VC/VO has made a substantial commitment for the NameSearch software, having license since 2001. NameSearch is a copyrighted, commercial, off-the-shelf product, developed by Intelligent Search, Inc. Intelligent Search, Inc. is the system owner and is the only company that has rights to modify the system source code. The cost of switching to a competing software maintenance service was assessed and determined not in the Government’s best interest. Procuring a different software system will have a severe impact on current users. To procure another software package, personnel would require extensive retraining, and any new system would have to run parallel to the existing network to allow for data transference and testing. Lost productivity and training costs would be unacceptably high and delay the department in fulfilling its mission. In sum, it is in the Government’s best interest to continue to procure software maintenance services from Intelligent Search, Inc. Interested parties may identify their capability to respond to this requirement. Responses to this notice must be received no later than 11:00 am EST Thursday, May 1, 2008. A determination not to compete this requirement is within the discretion of the Government. This notice may represent the only official notice. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements.
