The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to negotiate on a non-competitive basis with Engineered Arresting Systems Corporation, for 62 each Emergency Breakaway Lever Kits, part number 31000-751, with attaching hardware, tools and updating in stock surge brake assemblies in accordance with ECP-I-EAF-0431. ECP-I-EAF-0431 is required to fix an original design problem on the M31's current surge break lever system. This ECP is necessary to prevent damage during usage and will address the current safety concerns.

The Government intends to negotiate the above requirement under the authority of 10 USC 2304 (c) (1), FAR 6.302-1. Engineered Arresting Systems Corporation is the Original Manufacturer of the M-31 therefore; they are the only company that possesses the detailed technical data necessary to fulfill this requirement. This is not a request for competitive proposals. A determination by the Government not to open the requirement to competition based upon responses to this notice, is solely within the discretion of the Government.
