The US Army Corps of Engineers, Engineer Research and Development Center (ERDC) Contracting Office intends to issue a contract to Panalytical Inc., 117 Flanders Road, Westborough, MA 01581 on a sole source basis IAW FAR 13.106-1(b)(2) for the yearly maintenance of the X'Pert Pro MPD X-ray Diffractometer. Panalytical Inc. is the manufacturer of the instrument and uses proprietary parts in the equipment, integrated with existing hardware and software only provided by Panalytical Inc. This award will be made under simplified acquisition procedures as authorized by FAR 13.106-1(b). There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 811219 - Other Electronic and Precision Equipment Repair and Maintenance with a Small Business Size Standard of $20.5 Million.

This notice is not a request for competitive quotes or proposals. A solicitation will not be issued. However, the Government will consider all responsible sources received by the closing date specified in this notice. The information submitted must be provided in sufficient detail to demonstrate the vendor's ability to fulfill this requirement. The contractor must also provide a description of their past experience in fulfilling requirements which are the same or similar to this requirement and references for each.

Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this requirement on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.
