Subject: Maintenance Support for EOS M270 and EOS M290 Instruments
Introduction
This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested.
Purpose
The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with EOS of North America, Inc. located at 28970 Cabot Drive, Suite 700, Novi, MI 48377-2978. The purchase order will be for maintenance support for EOS M270 and EOS M290 instruments for a one-year base period and up to two one-year option periods.
Authority
This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 811219 – Other Electronic and Precision Equipment Repair and Maintenance with a size standard of $22 Million.

Sole Source Determination
The sole source determination is based on the following:
NIST owns and operates two direct metal sintering (DMLS) machines manufactured by EOS of North America, Inc. (EOSINT M270 and EOSINT M290 machines). The machines support research efforts in metals-based additive manufacturing (AM). In order to accurately report experimental research results and participate in material and process round robins, the current state of the machines' performance must be continually known and updated and maintenance for both machines must remain up to date. Further, since these machines are the main research platforms for the NIST's AM efforts, NIST must minimize the down time of these machines.
The ESOINT M270 and EOS M290 machines are proprietary to their original equipment manufacturer, EOS of North America. Maintenance for these machines may only be procured from this contractor; no other contractor has the capability or authorization to service the proprietary equipment. Additionally, NIST must ensure that the machines continue to operate exactly to manufacturer specification for continuity of on-going scientific research. Accordingly, EOS of North America, Inc. is the only contractor capable of addressing the Government's needs for this requirement.
