The Centers for Disease Control and Prevention (CDC), National Center for Environmental Health (NCEH), Division of Laboratory Sciences, intends to award a sole source contract to LECO, 3000 Lakeview Avenue, St. Joseph, MI 49085-2396 for the yearly maintenance service of Pegasus 4D TOF equipment.

The statutory authority for this sole source acquisition is 10 U.S.C 2304(c)(1) in accordance with FAR Part 6.302-1- only one responsible source and no other supplies or services will satisfy the agency requirement. The NAICS code for this procurement is 334516, Analytical Laboratory Instrument Manufacturing. The period of performance for this procurement is a 12 month base period and two 12 month options.

LECO is currently the only company that performs maintenance on the Pegasus 4D TOF MS system because they are the original manufacturer and the only one qualified to service their equipment. LECO is the manufacturer of the instrument system that we are seeking a maintenance agreement. They are the only supplier with the capability to maintain a supply of the latest parts and software upgrades. Additionally, their service engineers are qualified to work on the instruments and have the latest training and information related to instrument hardware and software systems. They have the capability to provide the necessary service within the timeframe needed and can ensure the accuracy and precision of the instrument.

As a result of this synopsis, no competitive solicitation will be posted on FedBizOpps. We will issue only one solicitation to LECO. However, all responsible sources that believe they can meet these requirements may submit their capabilities/qualifications statement to provide the services to Vallerie Redd via email ONLY at [email protected] with the solicitation number 2011-Q-13207 referenced in the subject line NO LATER THAN February 18, 2011.

A determination by the Government not to compete this proposed action will be based on responses to this notice and are solely within the discretion of the Contracting Officer. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
