The USDA Agricultural Research Service (ARS) intends to make an award, on a sole source basis, to ELEMENTAR AMERICAS, INC of New York, NY for the purchase of a maintenance and parts agreement for a vario Pyro cube instrument, SN 18123022, and an Isoprime 100 system, SN JD511. The award is will consist of a base period plus four options, not to exceed five years, and will have a total contract value of $94,400.85

These products are determined to be proprietary to the manufacturer for both support and warranty purposes, with no other known available entities as accepted resellers, and this action will not be competed in accordance with the authority of FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

The North American Industry Classification Code (NAICS) for this requirement is 334516, titled Analytical Laboratory Instrument Manufacturing, with a size standard of 1,000 employees.

THIS IS A NOTICE OF THE GOVERNMENT'S INTENT TO SOLE SOURCE THIS ACTION AND IS NOT A SOLICITATION FOR QUOTATIONS. However, all responsible sources may submit a capability statement, proposal, or quotation that shows the ability to provide the required services and which SHALL be considered by the Agency. The capability statement, or other information furnished, must contain material with sufficient detail to allow ARS to determine if the party can meet all of the requirements. The determination to compete this requirement in the future, based upon responses to this notice, is solely at the discretion of the Government.
