This is a notice of intent to award a sole-source purchase order and is not a request for competitive proposals. The Centers for Disease Control and Prevention (CDC), ONDIEH\NCEH\DLS hereby announces its intent to solicit and enter into a contract with LECO Corporation, 3000 Lakeview Avenue, St. Joseph, MI 49085-2396 for the procurement of a yearly maintenance contract for Pegasus 4D Time-Of-Flight (TOF) mass spectrometers.

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1) as cited in FAR 13.106-1(b)(1)(i). LECO Corporation is the original manufacturer of the Pegasus 4D TOF mass spectrometers and therefore is the only vendor that can provide 1) on-site repair which is usually the next normal business day response to service calls, 2) preventative maintenance and emergency repair actions during normal business hours, coordinated so that action can be accomplished with a minimum of interference to operational use of the equipment and 3) staff qualified to diagnose problems and repair and maintain LECO equipment. LECO supplements their own Field Engineers periodically to receive service information and updates of recent problems and suggested methods of correction. The original equipment warranty information states that the manufacturer only ensures performance at original levels if genuine manufacturer parts or manufacturer trained technicians provide service for equipment. No other vendor meets the needs of this requirement as LECO is the manufacturer of the Pegasus 4D TOF mass spectrometers specific to this proposed maintenance agreement and the only vendor that can perform the services necessary to meet government requirements.


The NAICS code for this acquisition is 811219 and the small business size standard is $19.0 million dollars. Award will be made using Simplified Acquisition Procedures found in FAR Part 13.

The Government will review any/all capabilities statements and pricing information submitted and determine if other qualified sources do exist that could provide this requirement. Information received in response to this announcement will be used solely for the purpose of determining whether to conduct a competitive procurement for these services and/or supplies in the future.


This notice of intent is not a request for competitive proposals, however, the Government shall consider all responses received within seven (7) days of this posting, in accordance with FAR 5.203 (A)(1). If no affirmative responses are received within seven (7) days, negotiations will be conducted with LECO Corporation as the only source and a contract will be issued without any additional notices being posted.


A determination by the CDC not to compete this proposed contract, based upon responses to this notification, is solely within the discretion of the Contracting Officer.
