The National Institute of Standards and Technology/Acquisition Management Division, (NIST/AMD) on behalf of the Materials and Structural Systems Division/Inorganic Materials Group, intends to negotiate on a sole source basis with Teledyne Instruments of Hudson, NH, for a two year full maintenance agreement for Teledyne prodigy ICP Spectrometer. The period of performance shall be two years from the date of award.

This requirement will be fulfilled using simplified acquisition procedures under the authority of FAR Parts 12 and 13.

The Inorganic Materials Group has the general mission of developing measurement science and technology for the construction materials industry. As part of that mission, the group needs to routinely measure the elemental composition of cementitious materials and solutions in contact with them. This requirement is a full maintenance agreement to maintain or repair the group's Teledyne Prodigy ICP Spectrometer and ensure that the instrument is consistently operational and performing at its optimum condition, thereby avoiding delays in reaching project milestones.

Teledyne Instruments is the sole manufacturer of the spectrometer and has proprietary rights to the equipment and all associated components and software. Teledyne Instruments confirmed that they do not have any authorized distributors or service providers, therefore, Teledyne is the only source for the maintenance agreement.

The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $19.0M.

No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by June 15, 2012, will be considered by the Government.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
