The Army Contracting Command-Aberdeen Proving Ground (ACC-APG), Fort Huachuca Division intends to award a sole-source contract under the authority 41 U.S.C. 1901(e)(2), 10 U.S.C. 2304(f), and FAR 13.501(a)(1)(ii) - Simplified Procedures for Certain Commercial Items to Harris Corporation located at 221 Jefferson Ridge Parkway, Lynchburg, VA 24501. The requirement is for commercially Land Mobile Radio (LMR) sustainment and software service which consist of the following:

The contractor shall provide service includes labor and parts for all portions of the system with the exception of those listed below as excluded. Response time for critical infrastructure failures will be four (4) hours from time of notification by customer until a technician is on-site at the point of most likely failure. Upon notification the technician may commence remote dial up access troubleshooting (if available) to make an initial assessment and possibly initiate a temporary work around solution. Even if dial up troubleshooting is initiated, the on-site response time will remain at 4 hours. As well as include all required replacement maintenance parts. As items are utilized from Fort Riley's spares inventory, the defective items will be shipped to a Repair and Return Center. R&R will repair or replace the item and return the item to Fort Riley where those items will be placed into Fort Riley spares inventory.

A major system failure necessitating a guaranteed 4-hour response time call out is defined as 60% of the system is down. This provision is from the original EDACS maintenance provisions. Defining what constitutes a 60% system failure may in some cases be difficult to determine. Fort Riley will have the right to declare an emergency response need at any time and Harris will respond to the request. Should the service call result in identification of a failure that would not, under common definitions, be considered to be an emergency call out, Harris will notify Fort Riley and will discuss the response in detail. Should it be determined that the call out did not constitute an emergency situation, Harris reserves the right to invoice for that call at Demand Service rates.

Comprehensive Preventative Maintenance services can detect issues with the system before they impact user operations. Actions can be taken to proactively address potential issues. The following items will be included in the Preventative Maintenance Services.

The contract will consist of a twelve month base period beginning 1 April 2019 through 31 May 2020. The North American Industry Classification System (NAICS) code is 811213. This Notice of Intent to award a Sole Source Contract is not a request for competitive proposals. Any responses or inquiries to this notice must demonstrate clear and convincing evidence that competition will be advantageous to the Government. All information received from this notice shall be used for planning and market research purposes only. The determination to refrain from competing proposed contracts based on responses to this notice is solely within the discretion of the Government. The Government will not pay for the preparation of any information submitted or use of such information. Acknowledgement of receipt of responses will not be made, nor will respondents be notified of the evaluation of the information received.
