This procurement action is being conducted under 6.302-1 with the authority of 41 U.S.C. 253 (c), as only one responsible source and no other supplies or services will satisfy the requirement; therefore proposals cannot be submitted directly on this notice. The U.S. Securities and Exchange Commission intend to award a sole-source firm fixed price purchase order to LexisNexis, 9393 Springboard Pike, Miamisburg, OH 45342-4424 for the renewal of annual maintenance support for LexisNexis Concordance software license. Due to the proprietary nature of the software, there are no known qualified vendors that have the necessary certifications/capabilities to perform the required services. The period of performance is September 1, 2009 through August 31, 2010. This is a notice of intent to award a sole source procurement action and is not a request for competitive proposals. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by this agency. The government does not intend to pay for any information submitted as a result of this notice.
