Notice of intent to award a sole source contract modification to LGS Innovations LLC for hardware and software upgrades to the JHITS Lucent 5ESS switches. LGS is the only manufacturer of the Lucent 5ESS switches. LGS is the only supplier that can provide the hardware and software needed to expand the JHITS switches to provide increased trunking connections to the JHITS switching network. Additionally, LGS is the sole provider of the required right to use (RTU) license agreements and Government must purchase RTU's directly from the supplier. RTU's are not transferable between suppliers. Government must procure RTU from the manufacturer, LGS, for licensing RTU and without ownership of the RTU, Government will not be able to ensure equipment is properly maintained based on manufacturer's specifications and Government may not be able to obtain necessary software updates without the RTU license agreement.
