The U.S. EPA intends to negotiate on a sole source basis with the Bruker Biospin Corporation for an annual maintenance agreement to service the Bruker Biospin Nuclear Magnetic Resonance (NMR) spectrometer. This NMR spectrometer is used by the Sustainability Technology Division, the Land Remediation and Pollution Control Division and The Water Supply and Water Resource Division located in the containment facility at EPA¿s Office of Research and Development (ORD), National Risk Management Research Laboratory (NRMRL) located at AWBERC, 26 West Martin Luther King Dr., Cincinnati, OH 45268. EPA has identified Bruker Biospin Corp. as the only contractor able to maintain the Bruker Biospin built NMR spectrometer. Bruker Biospin solely manufactured the NMR spectrometer using EPA provided specifications and its own proprietary technology. The spectrometer is used to identify unknown organic compounds either in liquid or solid samples. This highly specialized piece of equipment is operated through proprietary software also developed by Bruker Biospin. The maintenance agreement provides for the warranty of the equipment, software updates and the annual replacement of parts that undergo significant wear. Bruker Biospin , as the manufacturer of the instrumentation, possesses the unique capability and accessibility to the engineering specifications to ensure accurate operation of the spectrometer. The contractor shall also provide certified technicians capable of performing the requirements of the maintenance agreement. This procurement will be accomplished under FAR Part 12 Commercial Procedures. It is our intent to award a single fixed price purchase order consisting of one (1) 12-month base period and two (2) 12-month option periods for a potential term of 36 months. Interested firms may identify their interest and capability to respond to the requirement. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETATIVE QUOTATIONS. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government.
