17. This is a combined synopsis/solicitation, notice of intent for commercial items prepared in accordance with the format of FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are not being requested, and a written solicitation will not be issued. This solicitation is being issued as a Notice of Intent (NOI5012). This solicitation and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 01-25. The National Institute of Allergy and Infectious Diseases (NIAID) intends to procure maintenance on a sole source basis using Simplified Acquisition Procedures with Leica Microsystems for a period of twelve months. The instruments to be covered are the 1) Confocal Microscope Serial Number 175008 (basic instrument), Visible Laser UV Lasers and UV fibers; 2) Confocal Microscope Serial Number 195131 (basic instrument), Visible Lasers and UV Laser. The Contractor shall provide emergency repair service as required during the hours of 8:00 a.m.–5:00 p.m., Monday through Friday unless otherwise stated. Labor, travel and replacement parts, as required, excluding consumable items, unless otherwise stated. Leica will provide 1 planned maintenance inspection(s) per period unless otherwise specified. MP Ready Coverage includes couplings, fibers, NDD Detectors, MP Filterwheel, MP EOM, and labor/travel expenses associated with MP alignment and repair. UV Ready Coverage includes couplings, fibers, pinhole optics, UV Lenswheel/Filterwheel, UV AOTF, and labor/travel expenses associated with UV alignment and repair. One preventative maintenance visit is included per contract period, to be scheduled at customer’s request. The Period of Performance is 10/1/2004 through 9/30/2005. This is not a small business Set-Aside. Leica Microsystem is the sole manufacturer and is the only vendor that can provide compatible parts for these instruments, along with the technical expertise to meet our requirements. Changing vendors could introduce time consuming interruptions to ongoing studies. The North American Industry Classification System (NIACS) code for this acquisition is 811219 and the Small Business Set-Aside is 6.0 million. The FOB will be Destination, Bethesda, MD, 20892. This will be a firm-fixed price contract. The following Federal Acquisition Regulations provisions and clauses apply to the acquisition: FAR 52.212-1 Instructions to Offerors-Commercial Items; FAR 52.212-3 Offeror Representations and Certifications Commercial Items; FAR 52.212-4 Contract Terms and Conditions Commerical Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items; and FAR 52.204-7 Central Contractor Registration (2003). A completed copy of provisions at FAR 52.212-3 Offerors Representation and Certifications Commercial Items must be included. B(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the Central Contractor Registration (CCR) database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
