All of the above-listed manufacturers’ EULAs (End Use License Agreements) have been approved by GSA by means of a negotiated EULA or EULA rider.
Accordingly, expiration of Carahsoft’s contract GS-35F-0131R is expected to affect only customers that are looking to order software license and software maintenance (SINs 132-33, 132-34) offerings manufactured by VMWare, Inc. GSA is currently in the process of reviewing Carahsoft’s request to add VMWare’s offerings onto its successor contract GS-35F-0119Y, and is aiming to negotiate terms and conditions advantageous to the Government, including fair and reasonable pricing, that will benefit all customers. It is GSA’s intent to complete such negotiations prior to May 30, 2013, however, this timeline is tied to the level of the contractor’s and its manufacturer’s cooperation in this process.
Any existing BPAs against Carahsoft’s contract GS-35F-0131R for VMWare’s offerings shall cease on May 30, 2013. Any existing/ongoing task and/or delivery orders for this manufacturer’s offerings will be able to continue through the current period of performance. However, ordering activities will not be able to exercise options to existing task/delivery orders or place new orders. Carahsoft was provided notice from GSA of the expiration of its contract GS-35F-0131R, and was instructed to immediately contact all affected customers. GSA also simultaneously posted notification of the contract expiration on FedBizOpps.
