The Naval Air Warfare Center Aircraft Division (NAWCAD), Lakehurst in support of the Prototype, Manufacturing, and Test Department intends to solicit, negotiate, and award, on a sole source basis a total of 20 ILLLV RH Plugs (P/N 626725-6), and 20 LH Plugs (P/N 626727-6). It’s anticipated that a quantity of 14 RH Plugs (P/N 626725-6) and a quantity of 14 LH Plugs (P/N 626727-6) will be procured in the base period, and a quantity of six RH Plugs (P/N 626725-6) and a quantity of six LH Plugs (P/N 626727-6) will be procured for the option period.
The ILLLV Plug is a designated Aircraft Launch and Recovery Equipment Critical Safety Item. DFARS 209.270-3(a) states, “The head of the contracting activity responsible for procuring an aviation or ship critical safety item may enter into a contract for the procurement, modification, repair, or overhaul of such an item only with a source approved by the head of the design control activity." Technical Data Requirements (TDR) 21-17032 regarding the procurement of the ILLLV RH Plugs and TDR 21-17034 regarding the procurement of ILLLV LH Plugs identifies only one approved source, Pre-Mach Inc. in York, PA (CAGE: 5S946). In order to award to any other company than Pre-Mach Inc., an engineering and quality assurance audit would need to be performed on an interested company. The audit process generally takes twelve (12) months, which is an unacceptable delay to contract award and delivery.
All responsible sources shall meet all technical and quality assurance requirements detailed in the drawings listed below as well as the Technical Data Requirements (TDR) 21-17032 and 21-17033, and (Quality Management 1006) QM1006.

The referenced drawings contain technical data whose export is restricted by the Arms Export Control Act. In order for companies who are interested in becoming a qualified source to obtain the technical drawings, interested vendors must forward a current, approved DD Form 2345 "Military Critical Technical Data Agreement" to LeAnn Spann, Contract Specialist, via the e-mail specified in this notice. A submitted DD Form 2345 will be validated as being current with the Defense Logistics Agency's Logistics Information Service – Joint Certification Program. Drawings will be only provided to the individual identified as the data custodian on the approved form.

The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of 10 USC 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
