The Naval Air Systems Command intends to award a modification for a Cost Plus Fixed Fee (CPFF) effort on a sole source basis to Raytheon Company, in Goleta, California to contract N00019-09-C-0036. This additional CLIN and change of scope will require the Contractor to inspect, test, and fault isolate each failed/broken Integrated Multi-Platform Launch Controller (IMPLC) to determine the specific work required to restore it to a usable condition. The Contractor will also perform and verify the repair prior to returning this unit to the Government.
The contract modification will add two new base CLINS to support this new scope; with a period of performance of 23 September 2014 through 29 January 2015. The Option CLINs will have a period of performance of 30 January 2015 through 29 January 2016.
These requirements will be procured in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C 2304©(1), as implemented by FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." Raytheon Company is the original equipment manufacturer and the Navy's sole depot facility for the IMPLC. Because Raytheon has retained proprietary rights to the pwer supply, the Navy would need to acquire the technical data rights and productions for the IMPLC in order to complete it. The procurement of the data rights during the final procurement of IMPLCs was considered, however it was not cost-effective to procure the data and the rights; also the acquisition was unforeseen.
