The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole-source basis with Illumina Inc., under the authority of 41 US 3304 (a)(1), for an upgrade to a NIST-owned Illumina MiSeq NGS instrument (serial # M03301) to include installation and training.

The Applied Genetics Group (AGG) of the MML at NIST is working on developing standards and knowledge in forensics. A recent technological advance - DNA biometrics using next generation sequencing (NGS) - has become available for forensic applications. To fulfill its mission, AGG requires an Illumina MiSeq FGx upgrade so that it may run the forensic assay and characterize NIST forensic reference materials in a timely manner so that standard reference materials may be certified for use with NGS.

Sole source determination is based on the following:
In order to fulfill AGG's mission, it is necessary to procure an upgrade to NIST's existing Illumina MiSeq NGS instrument with parts and software that are 100% compatible and interchangeable with the system. Specifically, Illumina MiSeq FGx software and hardware components, a ForenSeq DNA Signature Prep kit, and a MiSeq FGx Reagent kit - all of which are manufactured by Illumina. Illumina has developed the required technology, has proprietary rights to the technology, and has no authorized distributors or resellers capable of providing the required technology and services. It is further noted that NIST's existing instrument is under warranty. Use of non-Illumina parts or service personnel will void the existing warranty.

The North American Classification System (NAICS) code for this acquisition is 334516 - Analytical Laboratory Instrument Manufacturing. The small business size standard is 500 employees.

No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 4:00 p.m. Eastern Time on May 19, 2015 will be considered by the Government.

A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
