NOTICE TO CONTRACTORS Pursuant to HRS 103D, electronic sealed offers via the Public Purchase System will be received up to 3:00 P.M., Hawai‘i Standard Time, on December 23, 2022 and recorded immediately for the Division of Purchasing, Department of Finance, for the Furnishing and Paying for all materials, labor, transportation, tools, equipment, machinery and services necessary to construct in place complete: ADA IMPROVEMENTS & RENOVATIONS AT WAIMEA CANYON PARK COUNTY OF KAUA‘I The contract awarded pursuant to this Solicitation will be funded by Federal Community Develipment Block Grant in compliance with the terms of its Financial Assistance Award. It is the responsibility of prospective offerors, offerors, and Contractors to comply with all applicable federal laws, regulations, executive orders, and the federal awarding agency’s policies, procedures, and directives including but not limited to all the requirements listed in the CONTRACT PROVISIONS FOR NON–FEDERAL ENTITY CONTRACTS UNDER FEDERAL AWARDS 2 C.F.R. Pt. 200, App. II attached hereto and incorporated herein. Bidders are further notified of the requirements of Act 190, SLH 2011, SB 758, wherein the County of Kaua‘i is required to utilize the Hawai‘i Compliance Express (HCE) to obtain proof of compliance with tax, registration, and labor requirements prior to the issuance of an award. Bidders are strongly encouraged to register via HCE to allow for needed proof of compliance prior to the issuance of an award. (HRS 103D-328, HRS 103D-310, HAR 3-122-112). The successful bidder will be required to conform to the wage requirements prescribed by the Federal Davis-Bacon and Related Acts which requires that all laborers and mechanics employed by contractors and sub-contractors performing on contracts funded in whole or in part with federal funds in excess of $2,000 pay their laborers and mechanics not less than the prevailing wage rates and fringe benefits, as determined by the Secretary of Labor, for corresponding classes of laborers and mechanics employed on similar projects in the area. The Director of Finance reserves the right to cancel this Invitation for Bid or to reject any or all bids in whole or in part if deemed to be in the best interest of the County.
