This synopsis is for information and planning purposes only and is not to be construed as a
commitment by the government. This is NOT a Request for Proposal, Invitation for Bid, or an
announcement of a solicitation. Response to this Sources Sought is strictly voluntary and will
not affect any firms' ability to submit an offer if a solicitation is released. There is no bid
package or solicitation document associated with this announcement. The purpose of this
document is to identify potential sources. Any requests for a solicitation package will be
disregarded. The Government does not intend to award a contract on the basis of this source
sought or otherwise pay for the information solicited. No entitlement to payment of direct or
indirect costs or charges by the Government will arise as a result of preparing submissions in
response to this sources sought and the Government's use of such information.
This Sources Sought is conducted to identify all potential sources capable of meeting the
requirements described in the Performance Capabilities below:

Required Performance Capabilities:
For IBV valve System used for medical procedure

The Spiration Incoporated are critical service that needs for critical ill patients at the Clinical Center. Spiration Incorporated provide the following services for IBV valve System

Deliverables

1) Spiration Inc agrees to ship Products to NIH (at no initial cost) once a request has been made to Spiration based on patient need.

2) All "Unused Products" are the property of Spiration Inc. until they become "Used Products" at which time they become the property of NIH and are charged accordingly for products used.

3) Spiration will use commercially reasonable efforts to provide timely delivery of the products. Shipping rates will be reflected on the final invoice.

4) Expedited delivery charges will be provided at an additional cost if requested by NIH to meet a requested delivery date.

5) NIH agrees to provide a purchase order number for all "Used Products" within 10 days of the procedure. An electronic /paper copy of the purchase order is not required by Spiration to finalize billing.
